How John Marshall Screwed Up America

John Marshall screwed up America. Don't think so? The modern Supreme Court is his creation. If you don't like the Supreme Court invalidating State law, blame Marshall. If you don't loose construction, blame Marshall. If you don't like the Supreme Court upholding clearly unconstitutional federal law, blame Marshall. In short, if you take offense to the out of control federal judicial branch, blame Marshall.

This course covers four of his most famous--or infamous--decisions and the 1788 speech that he made in the Virginia Ratifying Convention that sung a different tune. In other words, Marshall in 1788 was different from Marshall in 1821.

You get Marbury v. Madison, Fletcher v. Peck, McCullough v. Maryland, and Cohens v. Virginia. I go through each decision in detail and explain how Marshall screwed up America with each decision.

Marshall was no originalist. And our unconstitutional nationalist nightmare began with his inconsistent ruminations from the bench.
